The Conflict of Interest and Ethics Commissioner may investigate possible contraventions of the conflict of interest rules that he administers.
Under the Conflict of Interest Act, he may conduct an examination of the activities of a public office holder at the request of a Senator, Member of the House of Commons or on his own initiative.
Under the Conflict of Interest Code for Members of the House of Commons, he may conduct an inquiry of the activities of a Member at the request of another Member, on his own initiative or at the direction of the House of Commons.
A March 2009 Federal Court of Appeal decision confirmed that the public does not have standing in relation to the Act and that the Commissioner’s decisions on whether or not to pursue an examination on his own initiative are not subject to judicial review. When the Commissioner receives information from the public, however, he gives it careful consideration.
